What to know before you apply

Employing apprentices and trainees comes with some rights and responsibilities. 

  • Employers pay apprentices and trainees wages and entitlements in line with the industrial agreement. 
  • Employers pay apprentices and trainees during off-the-job training with their training provider and release them from work so they can attend.
  • Employers and apprentices and trainees sign a training contract. Either party can withdraw during the probationary period. 
  • Training contracts can be undertaken full-time or part-time but not on a casual basis.
  • Parties must apply to make any changes to their training contract, and to complete, suspend or terminate it.
  • Apprentices and trainees must be supervised during the term of the training contract according to the supervision guidelines (PDF).

How to apply for Employer Registration

How is your application assessed?

When you apply for employer registration, we call you to talk about your application and sometimes request an onsite meeting to come out and have a chat about what you and your apprentice or trainee can expect. We will also discuss with you the range of work you can provide apprentices and ensure you can provide the variety of work required.

We may also seek information from other agencies as part of the assessment.

We also need to check a few things to help your business get ready to employ apprentices and trainees, including:

Legal name

We need to know who is the legal entity employing your apprentices and/or trainees. A legal entity may be a:

  • sole trader
  • partnership
  • body corporate (e.g. a Pty Ltd company)
  • trustee of a trust
  • trading name/business name.

A business name is simply a name under which you conduct a business. You must register a business name in Australia, unless you trade under your own name, or fall within an exemption.

If you are unsure of your legal entity, your accountant or lawyer should be able to help.

Occupational licence

We also need to make sure that employers in a licensed occupation have the appropriate licence from Consumer and Business Services.

The body corporate (e.g. a Pty Ltd company) must hold its own licence. Please note that sole trader licences held by directors or shareholders do not authorise the body corporate to contract for that work.

Supervisor

We also assess the qualifications and experience of the supervisors nominated to train the apprentice or trainee (for example, hairdressing supervisors need to provide evidence of successful completion of Certificate III in Hairdressing).

Supervisors of apprentices in plumbing, gas-fitting, and electrotechnology must have the appropriate worker’s registration with Consumer and Business Services.

Ability to provide relevant 'on-the-job training'

As an employer, you provide 'on-the-job training' to your apprentices and trainees and the Registered Training Organisation provides 'off-the-job training'. To ensure your business is ready to give apprentices and trainees relevant on-the-job training, we need to check it has:

  • appropriate facilities, equipment and experienced supervisors to support training and supervision of apprentices in line with the training plan
  • relevant work appropriate to the vocation and to the successful completion of the qualification in the training contract.
